These Terms of Use ("Terms") are an agreement between you and [COMPANY LEGAL NAME] Ltd. Şti., a company registered in Türkiye at [STREET ADDRESS, POSTAL CODE, CITY, Türkiye] ("izmio", "we", "us"). They cover the izmio mobile app, the izmio.com website and related services (together, the "Service"). By downloading, opening or using izmio, you agree to these Terms, our Privacy Policy, our Consumer Health Data Policy, the Wellness & Safety Disclaimer, our Community Guidelines and, if relevant, the Founding Offer Terms.
Please read Section 6 (subscriptions and automatic renewal) and Section 17 (disputes) carefully.
1. Who can use izmio
- You must be at least 13 years old. If you are under 18, you may use izmio only with the permission of a parent or legal guardian who agrees to these Terms for you.
- You may not use izmio if the law prohibits it where you live, or if you are in a country or on a list subject to US embargoes or sanctions.
2. izmio is not medical care
izmio offers sound and listening rituals for relaxation, meditation and personal practice. It is not a medical device and does not diagnose, treat, cure or prevent any medical condition. Do not use it instead of professional care, and do not stop or change any treatment because of it. In an emergency call 911. In the US, if you are in crisis, call or text 988. Read the full Wellness & Safety Disclaimer before use.
3. Your account
- izmio creates an anonymous account when you first open the app. This version has no sign-in. Your purchases stay linked to your Apple or Google account and can be restored on a new device (Section 6.7).
- You are responsible for activity on your device and account. Tell us at [email protected] [VERIFY] if you think your account has been misused.
- You can delete your account at any time in the app or by following the steps at izmio.com/delete-account. Deleting your account or the app does not cancel a subscription; cancel through Apple or Google (Section 6.4).
4. License to use izmio
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use izmio on devices you own or control, for your own non-commercial use, under these Terms and the app store's rules. You may not:
- copy, record, redistribute, sell or publicly perform izmio sessions, sounds or texts, or use them in other products, broadcasts or commercial settings (for example, classes, studios or businesses) without our written permission;
- reverse engineer, decompile or try to extract source code, except where the law allows despite this restriction;
- bypass security, purchase checks or usage limits, or access the Service through automated means;
- use izmio in any unlawful way or in a way that harms others.
We own izmio, including its software, sessions, sound designs, texts, visuals and the izmio name and logo (™). These Terms do not give you any rights to them beyond this license.
5. The free plan
izmio has a free plan with no ads. It currently includes a daily personal session, a selection of sessions in every collection, every live circle, the first 3 days of each journey, Mosquito Watch, and 30 minutes of Pet Calm and 15 minutes of Garden Watch each day. Without izmio Infinite, Today offers one personal session a day; Infinite sessions opened that way play for up to 10 minutes; free library sessions stay free. The app shows what is free at any time. The content and limits of the free plan may change over time.
Live circles and free journey days are free on every plan. A session played inside a live circle, or on a free day of a journey, is free to play whatever your plan, even if the same session is part of izmio Infinite elsewhere in the app. Outside the circle, or after a journey's free days, the session follows its usual plan.
6. izmio Infinite: subscriptions and lifetime purchases
6.1 Plans and prices
izmio Infinite unlocks the full library and premium features. Prices below are for the United States storefront in US dollars. Prices in other countries are shown in the app store in your local currency and may include taxes.
| Plan | Price (USD) | Type | Free trial |
|---|---|---|---|
| izmio Infinite Monthly | $12.99 per month | Auto-renewing subscription | None |
| izmio Infinite Annual | $59.99 per year | Auto-renewing subscription | 7 days, for eligible new subscribers |
| izmio Infinite Lifetime (Founding) | $149.99 once | One-time purchase, not a subscription | — |
| izmio Infinite Lifetime | $199.99 once | One-time purchase, not a subscription | — |
The Founding lifetime price is limited to the first 1,000 founding purchases and is governed by the Founding Offer Terms. Before you pay, the app shows you the plan name, length, full price and what you get.
6.2 Free trial (Annual plan)
- The Annual plan comes with a 7-day free trial for eligible users. Eligibility is set by Apple or Google (usually one introductory offer per account).
- When the trial ends, you will be charged $59.99 for one year unless you cancel before the trial ends: on Apple, at least 24 hours before the end of the trial; on Google Play, before the trial ends.
- We will remind you two days before your trial ends and you are charged, with the date, how to cancel and, when available, the price. The reminder is a notification on your device; if you have not allowed notifications, the app shows it as a card on the Today screen instead (Section 6.5). If you cancel before then, there is no reminder.
- If you cancel during the trial, on Apple your free access may end immediately or at the end of the trial depending on Apple's rules; on Google Play you keep access until the trial ends.
6.3 Automatic renewal
izmio Infinite Monthly and Annual renew automatically until you cancel.
- Payment is charged to your Apple Account or Google Play account when you confirm the purchase or, if you started a free trial, when the trial ends.
- Your subscription renews for the same period (one month or one year) at the then-current price unless you cancel at least 24 hours before the end of the current period (on Google Play, before the renewal date).
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel at any time in your Apple or Google account settings. Canceling stops future renewals; you keep access until the end of the period you already paid for.
By starting a subscription you give your express consent to these recurring charges. We keep a record of that consent as required by law.
6.4 How to cancel
Canceling takes a few taps and is at least as easy as subscribing.
- iPhone or iPad: open Settings › [your name] › Subscriptions › izmio › Cancel Subscription. (Apple instructions)
- Android: open the Google Play Store › your profile icon › Payments & subscriptions › Subscriptions › izmio › Cancel subscription. (Google instructions)
- In izmio: You › Settings › izmio Infinite › Manage subscription takes you straight to the right store page.
Deleting the app or your izmio account does not cancel a subscription. [VERIFY Android menu names against the current Google Play Store app before publication; the iPhone steps match Apple's support page as of October 2026]
6.5 Reminders and notices
- Confirmation: before you confirm, the app shows the plan, price, renewal terms and how to cancel, and Apple or Google send you a receipt after you subscribe or start a trial. [VERIFY with counsel: whether izmio must also send its own confirmation, for example by email under California law]
- Trial reminder: two days before your 7-day trial ends (Section 6.2).
- Annual renewal reminder: 31 days before each annual renewal, while auto-renew is on, we remind you of the renewal with the date, how to cancel and, when available, the price. If you turn off auto-renew, there is no reminder. [VERIFY with counsel: whether state law (for example, California) also requires a yearly reminder for monthly subscribers; the app sends renewal reminders only for the annual plan]
- Price changes: if the price of your subscription goes up, we will tell you in advance, within the notice periods required by law and the app store, and Apple or Google may ask for your consent. You can cancel before the new price applies.
How reminders reach you. The trial and renewal reminders are notifications that the app schedules on your device; they do not come from our servers. The app asks for permission to send notifications only after you finish your first session, never during onboarding. If a reminder would arrive between 9 pm and 9 am your local time, the app schedules it earlier instead (at 6 pm that evening, or the evening before if it would fall after midnight), never later. If you have not allowed notifications, the app shows the renewal reminder as a banner in the app from 31 days before the renewal date, and the trial reminder as a card on the Today screen. Whether or not you allow notifications, the paywall and these Terms state how to cancel (Section 6.4). We do not currently send these reminders by email. [VERIFY with counsel: whether email notices are required]
6.6 Billing and refunds
Apple and Google bill all purchases, so their terms and refund policies apply. To request a refund, use Apple's Report a Problem or Google Play's refund process. We cannot issue refunds ourselves for store purchases, but we will help where we can and where the law gives you a right to a refund. If a purchase is refunded, the related access ends. A refunded founding purchase does not reopen a founding spot.
6.7 Lifetime purchases
- In short: Infinite Lifetime includes all izmio Infinite content; devices and separately sold products are excluded.
- izmio Infinite Lifetime is a one-time purchase, not a subscription. It never renews and never charges you again.
- What it includes: all izmio Infinite content and features, including Infinite content and features we add in the future, for as long as we offer izmio Infinite.
- What it does not include: physical devices (for example, any future external sound device) and products or services we sell separately and clearly label as separate at the time of sale.
- "Lifetime" means the lifetime of the izmio Infinite service, not the lifetime of a person or device. If we ever decide to discontinue izmio Infinite, we will give lifetime members at least [90] days' notice and will try, in good faith, to keep features that run offline on your device working. [VERIFY with counsel: discontinuation commitment]
- Your lifetime access is linked to the Apple or Google account you bought it with. Use Restore Purchases in the app to recover it on a new device with the same store account. This version has no sign-in, so access does not carry over between iPhone and Android. [VERIFY with workstream A: cross-platform entitlement and Family Sharing setting]
6.8 Changes to features and plans
We work to make izmio better and may add, change or remove content and features. If we remove a major paid feature during a subscription period you already paid for, we will offer a fair remedy as the law requires. Changes to subscription prices follow Section 6.5.
6.9 Codes and promotions
Offer codes, creator codes and promotions are subject to the terms shown with them and the app store's rules. They have no cash value and cannot be resold.
7. Content, sessions and live circles
- izmio generates tones and binaural beats on your device and layers them with recorded textures. Session descriptions include tradition notes and, where research exists, short science notes. Tradition is presented as tradition, not as scientific fact.
- Live circles start at the scheduled times shown in the app. Every participating phone plays the same session at the same server time; no audio is streamed. Schedules and hosts may change. The listener counter shows real listeners; we never inflate it. Sessions played inside a live circle are free on every plan (Section 5).
8. AI voice disclosure
Circle introductions and some guidance are voiced by "izmio Guide," an AI-generated voice created with a third-party voice synthesis service (currently ElevenLabs). izmio Guide is not a real person. The app labels it as AI. Circles led by Founding Guides are recorded by real people and are labeled with their names. We do not create AI copies of any person's voice without that person's written consent.
9. Your content
- What counts as your content: journal entries, reactions, share cards you create, feedback and anything else you submit.
- You own your content. You give us a worldwide, non-exclusive, royalty-free license to host, store, process and display it only as needed to run izmio for you (for example, syncing your journal if you turn on sync, or showing reactions to other listeners). Your journal is stored on your device, encrypted, unless you turn on sync, and it is private unless you choose to share it.
- Feedback: if you send ideas or suggestions, we may use them without obligation to you.
- You promise that your content does not break the law or anyone's rights and follows the Community Guidelines. We may remove content or restrict accounts that violate them.
10. Acceptable use
Do not use izmio to harass others, post unlawful, hateful or sexual content, give medical advice or encourage others to stop treatment, spam, impersonate anyone, interfere with the Service, or break any law. Details are in the Community Guidelines.
11. Animal modes
Pet Calm, Garden Watch (including Watch Mode, which keeps Garden Watch playing with the screen dimmed) and Mosquito Watch play audible sounds through your phone or a connected speaker. You are responsible for how and where you use them, including volume, local noise rules and quiet hours, wildlife laws and the welfare of your pets and other animals. Garden Watch sounds may startle animals; results vary and animals usually get used to sounds over time. Mosquito Watch is a monitoring tool and not a repellent. It won't keep mosquitoes away, prevent bites or protect against disease. Read the animal-mode section of the Wellness & Safety Disclaimer.
12. Third-party services
izmio works with services from Apple, Google, RevenueCat and others, and lets you share to social platforms. Their terms and privacy policies apply to your use of them. We are not responsible for third-party services.
13. Copyright complaints
If you believe content on izmio infringes your copyright, send a notice to our designated agent: [NAME], [ADDRESS], [email protected] [VERIFY: register the DMCA agent with the US Copyright Office before launch]. Include the details required by 17 U.S.C. § 512(c)(3).
14. Disclaimers
To the extent the law allows, izmio is provided "as is" and "as available." We do not promise any particular result from using izmio, including any change in mood, sleep, focus, finances or animal behavior, and we do not guarantee that the Service will be uninterrupted or error-free. Some places do not allow these disclaimers, so they may not apply to you.
15. Limitation of liability
To the extent the law allows, izmio and its owners, employees and partners will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of izmio. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) US $50. Nothing in these Terms limits liability that cannot be limited by law, such as for gross negligence, fraud, or death or personal injury caused by negligence.
16. Indemnity
If you use izmio in breach of these Terms or the law and that causes a claim against us, you agree to cover our reasonable losses and costs, to the extent the law allows.
17. Disputes and governing law
Please contact us first. Most concerns can be solved quickly at [email protected].
- Governing law: [GOVERNING LAW — to be decided by counsel, e.g., the laws of the State of [STATE], USA, or of the Republic of Türkiye], without regard to conflict-of-law rules.
- Forum / arbitration: [DISPUTE RESOLUTION CLAUSE — to be decided by counsel. Options include individual arbitration with a class-action waiver and small-claims carve-out, or courts in a named venue. Counsel should check enforceability for consumers in each launch market.]
- Nothing in these Terms takes away rights you have under the mandatory consumer laws of the place where you live.
18. Ending these Terms
You can stop using izmio and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms or the law, or if we must for legal reasons. If we end your access without cause, we will refund the unused part of any prepaid subscription or tell you how to obtain a refund from the store, where the law requires. Sections that by their nature should survive (such as 4, 9, 14–17) survive termination.
19. Changes to these Terms
We may update these Terms. We will post the new version with a new date and, for material changes, tell you in the app or by email before they take effect. If you keep using izmio after that, the new Terms apply. If you do not agree, stop using izmio and cancel any subscription.
20. Apple App Store terms
If you downloaded izmio from the Apple App Store:
- These Terms are between you and izmio, not Apple. izmio, not Apple, is responsible for the app and its content.
- Your license is limited to using the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation.
- izmio, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims the app infringes its intellectual property, izmio, not Apple, is responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not located in a country subject to a US government embargo or designated as "terrorist supporting," and you are not on any US government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
21. General
These Terms, together with the policies linked above, are the entire agreement between you and izmio about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them in a merger, acquisition or sale of assets. The English version controls where translations differ, unless the law requires otherwise.
